JUSTICE LALITHA KANNEGANTI - 3 - HC-KAR NC: 2025:KHC:54551 WP No. 14014 of 2025 ORAL ORDER The present writ petition is filed seeking the following prayer: "WHEREFORE, it is prayed that this Honourable Court may be pleased to: a) Issue a writ of certiorari and quash/set-aside the Impugned Final Order dated 26/04/2023 passed by the Hon'ble Presiding Officer, Debts Recovery Tribunal-2, Bangalore in S.A.No:338/2021 vide ANNEXURE-A; b) Issue a writ of certiorari and quash/set-aside the Impugned E-Auction Sale Notice dated 08/10/2021 issued by Respondent No.1 Bank vide ANNEXURE-K; c) Issue a writ of certiorari and quash/set-aside the Impugned Registered Sale Certificate dated 05/10/2023 vide ANNEXURE-T; d) Pass any such order or direction as deemed fit in the facts and circumstances of the case, in the interest of justice and equity." 2. Learned counsel for the petitioner has raised several grounds with regard to the irregularity in conducting the sale with regard to the reserved price and several issues pertaining to the manner in which the sale is conducted has been questioned before this Court. The petitioner prayer is to quash the order dated 26.04.2023 passed by the Debts Recovery Tribunal and also E-Auction Sale Notice dated 08.10.2021 and the Sale Certificate dated 05.10.2023. - 4 - HC-KAR NC: 2025:KHC:54551 WP No. 14014 of 2025 3. The petitioner has an effective alternative remedy and he can agitate all these issues before the appropriate forum, but not before this Court. Hence, this Court is passing the following: ORDER i. Accordingly, the writ petition is disposed of giving liberty to the petitioner to avail appropriate remedy. ii. The petitioners will have the benefit of Section 14 of the Limitation Act from the date of filing of this writ petition. iii. All I.As. in this petition shall stand closed.
