HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 30221 of 2025 Court No. - 40 HON'BLE SARAL SRIVASTAVA, J. HON'BLE AMITABH KUMAR RAI, J. 1. Heard learned counsel for the petitioner and learned Standing Counsel for the State. 2. The grievance of the petitioner is that he has been issued a notice dated 21.08.2025 by the Executive Officer, respondent no. 4, requiring him to remove an alleged illegal encroachment. 3. It is contended that the petitioner has already submitted his reply to the said notice on 22.08.2025, categorically denying the allegation of encroachment upon any land of the Nagar Panchayat. However, the said objection has not yet been considered or decided by the respondent no. 4. 4. Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending, as it is the competent authority, who has to decide the matter. 5. Accordingly, the writ petition is disposed of with liberty to the petitioner to file a fresh, detailed representation ventilating his grievance against the notice dated 21.08.2025 before the respondent no. 4 within a period of one month from today. In the event such representation is filed, the respondent no. 4 shall consider and decide the same strictly in accordance with law, after affording due opportunity of hearing to the petitioner, within a further period of two months.
