(ORAL) Petitioner seeks regular bail in case arising out of FIR No. 53 dated 11.05.2025 under Sections 127(6), 137(2), 87 of Bharatiya Nyaya Sanhita, 2023, registered at Police Station Bassi Pathana, District Fatehgarh Sahib. This is the first petition for regular bail. The FIR was registered on statement of father of the prosecutrix, who alleged that on 08.05.2025, when he had gone to Amloh, at about 11.30 AM, his wife received a phone call from his mother, informing that his minor daughter had gone to Bassi Pathana market to buy goods at 10.30 AM, but did not return. He and his wife searched for their minor daughter, but could not find her anywhere. Later, they learnt that Gurdeep Singh @ Sunny @ Jundi son of Avtar Singh, had enticed away his daughter on the pretext of marriage. AJAY GOSWAMI 2025.09.26 18:27 I attest to the accuracy and integrity of this document CRM-M-44246-2025 (O&M) -2- Learned counsel for the petitioner submits that petitioner had been falsely implicated and prosecutrix had gone with him of her own sweet will. In this context, he referred to statement of prosecutirix recorded under Section 183 BNSS (Annexure P-2). Learned counsel further submitted that earlier also, a similar case was got registered against the petitioner under Sections 363, 366 IPC, by mother of the prosecutrix and in that case, the petitioner had been acquitted on 15.09.2023. He prayed that petitioner be enlarged on regular bail. Learned State counsel has filed status report by way of affidavit of Raj Kumar, PPS, Deputy Superintendent of Police, Sub Division Bassi Pathana, District Fatehgarh Sahib along with custody certificate. The prayer for bail has been opposed on the ground that even in the past, petitioner persuaded the prosecutrix to leave her parents home and allured her for marriage. Moreover, petitioner was involved in 04 other cases. Thus, he did not deserve the concession of bail. Respondent No. 2, who is in person, also opposes the prayer for bail. Petitioner is in custody for the last more than 04 months. Challan has been presented in the case, though witnesses are yet to be recorded. Previously, petitioner was acquitted in the case under Section 363 and 366 Indian Penal Code in another FIR lodged by mother of the prosecutrix. Considering all relevant facts and circumstances of the case, but without commenting on the merits, the petition is allowed.
