CMP No. 21254 of 2025 ORDER CMP No. 21254 of 2025 has been filed to condone the delay of 441 days in filing the petition to set aside the abatement of the above suit. CMP No.21256 of 2025 has been filed to set aside the abatement caused due to the death of the 3 rd respondent. CMP No.21258 of 2025 has been filed to bring on record and implead the proposed respondents 2 to 5 herein who are the legal heirs of the deceased/Saroja 2 nd respondent. 2. The proposed respondents 2 to 5 herein, have stated that they have filed the above C.M.S.A to set side the Judgment and Decree dated 07.09.2011 made in AS No.12/2011 on the file of Subordinate Judge Tiruvarur. It is further stated that during the pendency of the CMSA, the above said Saroja 2 nd respondent.

CMP No. 21254 of 2025 of either the name of the Counsel or his address and the petitioners were unable to contact the counsel and only recently the petitioners came to know the particulars regarding the name and address of the counsel. It is further submitted that the delay is neither willful not wanton but only due to the bona fide reason. The learned counsel thus sought to excuse the delay. 3.The learned counsel appearing for the appellants submits that they has no serious objection in allowing the petitions. 4.
