Gangisetty Rajeswara Rao The Court made the following: 2 BSB, J W.P.No.5344 of 2025 O R D E R: This writ petition is filed under Article 226 of the Constitution of India to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents herein, in withholding the payment of bills net amount of Rs.20,50,995.020/- (Gross Rs. 22,43,958.020/-), under the CFMS.No.2024-281534 even after finalizing the bills payable to the petitioner in relation to the work i.e., 'construction of compound wall with MS Arches and In and Out Gates in Sub-Market Yard, Mangasamudram of A.M.C, Chittoor in Chittoor District vide Agreement No. 13/2022-23, Dt. 16.05.2022' is questioned, as the same is illegal and arbitrary apart from violative of Articles 14, 16, 19 and, 300-A of the Constitution of India and consequently direct the respondents to consider for payment of bills net amount of Rs.20,50,995.020/- (Gross. Rs.22,43,958.020/-) under the C.F.M.S.No.2024-281534 with an interest @ 24 percent per annum for the delayed amount to the petitioner in respect of execution of above-mentioned work forthwith. 2. Sri P.Chaitanya, learned counsel representing the counsel for the petitioner represented that the petition is withdrawn since the amount was paid. 3. The learned counsel for the 6th respondent represented that the amount was paid. 4. In view of the representation on both sides, the petition is dismissed as infructuous.
