The facts leading to filing of the present Writ Petition are 1. 2. as follows:- The Petitioner claims to be the owner of the land of an extent of 131.49 Sq. Yards situated in Sy.No.465-5B, 10‘^ Ward, 10“^ Block at Kotha Bypureddipalem Village, Narsipatnam Municipality, Anakapalli District, got acquired the same by way of a Settlement Deed dated 26.05.2020 vide document bearing No. 1949 of 2020. According to the Petitioner, the access to the said property is 12 feet pathway by way of easement from the C.C. Road. As the un-official Respondent Nos.4 to 6 had constructed a boundary wall, which interdicts the rights of the Petitioner’s access to his house, a suit O.S.No.10 of 2024 was filed by the Petitioner before the Principal Junior Civil Judge, Narsipatnam for grant of permanent injunction. In view of the construction made by the un-official Respondent Nos.4 to 6 thereafter, the suit was amended seeking relief of demolition of compound wall. \ 2 % 4^ It is the plea of the Petitioner that the construction in the site of un-official Respondent Nos.4 to 6 would close the access to their house and in that context the Petitioner made a representation to the Respondent No.3-Municipal Corporation on 01.02.2025 objecting to grant any plan for construction in the said site. As the Respondent No.3-Municipality is not considering the representation made by the Petitioner, the present Writ Petition is filed. Heard M/s. N. Ramesh Babu, learned counsel for the Petitioner and Smt. Sireesha Rani Vallabhaneni, learned Standing Counsel appearing for the Respondent No.3-Municipality. The learned Standing Counsel for Respondent No.3-Municipality has submitted written instructions issued by the Respondent No.3- Municipality vide Roc.No.60/2025/G1, dated 03.03.2025, wherein it was mentioned that there is a civil dispute between the Petitioner and the un-official respondents, the Respondent No.3 is not entitled to involve in the matter relating to easementary rights when the dispute between the parties is pending. It was further stated that the Respondent No.4 had applied online for building permission as per A.P. Building Rules, 2017 by enclosing registered ownership documents showing the title in his favour and the building permit order was generated in automated process basing on the documents uploaded. In the post verification of the building permit issued in favour of the Respondent No.4, the Respondent No.3-Municipality had issued a shortfall endorsement for shortage of road widening registered Gift Deed and consequently issued stop work order restraining the building construction by the Respondent No.4. It was also mentioned that the Respondent No.4 has not made any construction except the compound wall, which was constructed long back. 3. 4. 5. 6. 3 7. Considering that building permission and the stop work order this Court is of the opinion that the Writ Petition may be disposed of directing the Respondent No.3-Municipality to consider the representation made by the Petitioner dated , 01.02.2025 notwithstanding the pendency of the oivil suit regarding the ingress and egress to his house situated behind the un-official respondents 4 to 6 within three (3) months proposed construction of from today. 8.
