ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer:
“…..to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents and more particularly the action of the 4th respondent in terminating the services of the petitioner as watchman, without any enquiry and in violation of the Principles of Natural Justice and violation of Articles 14, 19 and 21 of the Constitution of India and

also stigmatic in nature consequently direct the respondents to continue the petitioner as watchman with all consequential benefits and to pass such other
order or orders…...”

When the matter is taken up for hearing, Sri Ganta Rama Rao, learned Senior Counsel, assisted by Sri Y.V.K.Chakravarthy, learned counsel for respondent No.4, would submit that at present all the posts are surrendered. Now the school has become unaided school. There is no appointment order to the petitioner. Parents of the students used to pay some amount to maintain the cycle stand. No service certificate has been placed on record. Learned Senior Counsel would further submit that now the petitioner is discontinued long back. Aided posts are exhausted. No aided post is available to regularize the petitioner as Watchman. The cause of action does not survive in this matter.

Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of.
4. In the light of the representation referred supra, the Writ Petition is
disposed of. There shall be no order as to costs.
