By way of present appeal, challenge has been laid to the judgments and decrees dated 27.03.2015 as well as 02.12.2016 passed by the Courts below, whereby, the suit for recovery filed at the instance of appellant-plaintiff respondents-plaintiffs, was partly decreed. 2. Admittedly, during the pendency of present appeal, the parties to the litigation have entered into a settlement and a written settlement/agreement dated 11.01.2024 (Annexure A-1) has been placed on record by the appellant along with application bearing CM-11770-C-2025. 3. In view of the settlement arrived at between the parties, learned counsel for the appellant prays for withdrawal of the present appeal. 4.
