This is a petition filed under Section 482 of BNSS for grant of concession of anticipatory bail to the petitioner in case FIR No.23 dated 27.03.2025 under Sections 118(1), 115(2), 126(2), 351(3), 190, 191(3), 3(5) of BNS 2023 and Section 118(2) of BNS, 2023 added later on, at Police Station Patara, District Jalandhar Rural. 2. Present case was registered on the basis of statement given to the Police by Tejinder Singh with the allegations that on 23.03.2025 at about 4:45 PM, he was going to his house on his motor-cycle and when he reached near the building of Gobindi Ispat, Simranjeet Singh armed with a sword, Arshdeep Singh (present petitioner) armed with baseball bat and four unkown persons, armed with wooden sticks were standing there, who stopped him out of whom, Simranjeet Singh exhorted the other accused to teach him a lesson for not returning the RENU 2025.09.05 14:42 I attest to the accuracy and integrity of this document Chandigarh CRM-M-45180 of 2025 -2- money. Simranjeet gave a sword blow on the backside of his head, as a result of which, he fell down and he gave another sword blow but to save himself, he raised his right hand and sword hit his index finger. Petitioner – Arshdeep Singh gave multiple base ball bat blows on his left leg and thereafter, all of them started dragging him on the road to take him to the other side of the road. Complainant caught one iron wire on the divider of the road and then Simranjeet Singh gave a sword blow on his right hand and the persons accompanying them also caused injuries to him. Arshdeep Singh – accused gave multiple base ball bat blows on his body and when he raised an alarm, assailants fled away in their vehicle. He further alleged that reason for causing injuries to him was that Simranjeet Singh was demanding Rs.15,000/- which was allegedly borrowed by his mother from Simranjeet Singh but his mother had already passed away and he was not aware about the transaction. Complainant sought action against the accused. 3. During investigation, complainant was got medico legally examined and he was found to have received 8 injuries out of which injuries No.1 to 3 were caused with sharp edged weapons and injuries No.4 to 8 were caused with blunt weapon. Accused- Simranjeet Singh was arrested on 06.04.2025. Apprehending arrest, petitioner- Arshdeep Singh applied for anticipatory bail which was rejected by the trial Court. 4. Status report by way of an affidavit of Kulwant Singh, PPS, Deputy Superintendent of Police, Sub-Division Adampur, Jalandhar (Rural) has been filed and the same is taken on record. 5. I have heard learned counsel for the parties and the material placed on the file has been perused. Learned counsel for the petitioner has argued that the petitioner has been falsely implicated. The main accused, namely, Simranjeet Singh to whom grievous injuries are attributed, has already been released on regular bail by the trial Court. Only simple injuries are attributed to the petitioner and he is ready to join the investigation and to abide by the conditions that may be imposed by the Court. In these circumstances, benefit of anticipatory bail be extended in his favour. 7. On the other hand, learned State Counsel has opposed the bail and argued that the petitioner has committed a heinous offence and he along with Simranjeet Singh and four unkown persons, launched an assault upon the complainant. Simranjeet Singh caused injuries with sword and one injury has been declared grievous in nature while two injuries are under observation and petitioner caused injuries to the victim with base ball bat. The victim has suffered eight injuries in all which shows that he was mercilessly beaten. Learned State Counsel further argued that names of the unknown assailants are yet to be ascertained and the weapon of offence and vehicle in question too have to be recovered. The custodial interrogation of the petitioner is thus required and in view of gravity of offence, he does not deserve concession of bail. 8. Victim has suffered eight injuries in all out of which, injury Nos.1, 2 and 3 were caused with sharp edged weapon and one of the injury has been declared to be grievous in nature. Petitioner along with other accused launched an assault upon the complainant while armed with sword and base ball bat and the complainant was mercilessly beaten. The weapon of offence and vehicle used in committing the crime are yet to be recovered and names of the accused who have RENU 2025.09.05 14:42 I attest to the accuracy and integrity of this document Chandigarh CRM-M-45180 of 2025 -4- not been arrested, too have to be ascertained for which the custodial interrogation of the petitioner is required and in view of gravity of offence, the petitioner does not deserve concession of bail.
