The instant petition has been filed with the following prayers :- "i) Issue a writ, order or direction in the nature of Mandamus directing the Respondent 2 to decide and take appropriate decision on the representation dated 12.08.2025 submitted before the Respondent No. 2 respectively) within stipulated time period as may be fixed by this Hon'ble Court and direct the respondents to appoint the petitioner on Class-III, post under Dying in Harness Rules. ii) Issue a writ, order or direction in the nature of Mandamus directing the respondents to appoint the petitioner on Class-III, post under Dying in Harness Rules within stipulated time period as fixed by this Hon'ble Court." At the very outset learned counsel for respondent-B.S.A. as well as learned Standing Counsel for the State submit that the controversy involved in the present petition has already been decided by this Court vide its judgment and order dated 2nd September, 2025 passed in the case Versus Counsel for Petitioner(s) : Madan Ji Pandey Counsel for Respondent(s) : Ashish Kumar (Nagvanshi), C.S.C. Utkarsh Kumar Tripathi .....Petitioner(s) State of U.P. and Another .....Respondent(s) of Radha Rani vs. State of U.P. And 3 Others (Writ-A No.12986 of 2025).
