1. By way of this petition under Article 227 of the Constitution of India, the petitioner seeks a direction to the Principal Judge, Family Court, District Jalandhar to expeditiously dispose of the applications dated 26.09.2023 (Annexure P-2) and 11.03.2024 (Annexure P-6), pertaining to visitation rights of his minor son, Master Arman Singh. The petitioner submits that his petition under Sections 9 and 13 of the Guardians and Wards Act, 1890, seeking appointment as the guardian of the minor, is pending before the Principal Judge, Family Court, Jalandhar. However, the proceedings are progressing at a snail’s pace, and several applications, including those annexed as Annexures P-2 to P-6, have remained pending for an extended period. It is submitted that proceedings before the Family Court ought to be conducted expeditiously, in keeping with the objective GAURAV SOROT 2025.08.13 16:20 I attest to the accuracy and integrity of this document
CR-5422-2025 (O&M) -:2:- behind the enactment of the Family Courts Act in mind, which mandates prompt resolution of family disputes through dedicated Courts.
2. A perusal of the interim orders placed on record by the petitioner clearly indicates that the purpose of establishing exclusive Family Courts is not being achieved, as the proceedings are being adjourned without any effective progress. Therefore, it is necessary to issue a direction to the Family Court to take up the applications (Annexures P-2 and P-6) for
consideration on merits and to dispose them off expeditiously. The said applications shall be decided within a period of one month from the next date fixed before the learned Family Court. The petition is accordingly
disposed of.
3. Since the main case has been decided, pending miscellaneous application(s), if any, stands also disposed of.
