The present writ petition has been filed praying to quash the impugned First Information Report dated 09.05.2025 registering Case Crime No. 22 of 2025, under Sections 498-A, 323, 504, 506, 354 and 313 I.P.C., Police Station- Moolganj District-Kanpur Nagar and for a direction to the respondents not to arrest the petitioner in pursuance of impugned first information report. It has been argued by the counsel for the petitioners that from the recital in the first information report, it is apparent that no offence under Section 313 I.P.C. is made out so far as the present petitioners are concerned who are in-laws of the first informant and the said offence concerns only husband of the first informant. It has been argued by the counsel for the petitioners that so far as the other offences referred in the first information report, the imprisonment for the said offences is not more than 7 years. It has been further argued that the first information report has been lodged with mala fide intention to harass the petitioner. It has been argued that for the aforesaid reason, the first information report is liable to be quashed. A.G.A. representing the respondents opposes the petition. It would serve no purpose to keep the present petition pending. After considering the rival submission of the parties, the writ petition is disposed of with a direction that the petitioners shall not be arrested in pursuance to the First Information Report dated 09.05.2025 registering Case Crime No. 22 of 2025, under Sections 498-A, 323, 504, 506, 354 and 313 I.P.C., Police Station-Moolganj District-Kanpur Nagar till submission of police report under Section 173(2) Cr.P.C./193 B.N.S.S.
