JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 06-02-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in a case registered under Sections 406, 420 and 120-B of the Indian Penal Code. 3. As per the F.I.R., during audit by charted accountant it surfaced that at Gram Panchayat Raj, Sabikpur, this petitioner along with other co-accused persons withdrawn government money twice for the same scheme. 4. Learned counsel appearing on behalf of the petitioner submits that petitioner is quite innocent and has committed no offence as alleged in the FIR. At the relevant time, petitioner was Mukhiya of the aforesaid Panchayat. When aforesaid defalcation came to the knowledge of this petitioner, the alleged defalcated money of Rs. 5,46,622/- was deposited in the account Patna High Court CR. MISC. No.90178 of 2024(2) dt.06-02-2025 2/2 of Panchayat on 07.04.2022. 5. Learned A.P.P. for the State opposed the prayer for bail. 6. Having considered the fact that the alleged defalcated money has already been deposited by the petitioner, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S.
