This criminal petition is filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [for short ‘B.N.S.S.’] seeking to quash the proceedings in C.C. No.4793 of 2022 pending on the file of the Judicial Magistrate of First Class, Kurnool. 2. Petitioner No.1 is the father of A.1. Petitioner No.2 is the sister of A.1, and petitioners 3 to 5 are the brothers of A.1. The learned counsel for the petitioners submits that the 2nd respondent has filed a case under Sections 498-A and 506 of the Indian Penal Code, 1860 read with Sections 3 and 4 of the Dowry Prohibition Act, 1961. It is submitted that the petitioners are in no way connected with the marital disputes between the de facto complainant and A.1 and that they are living separately. 3. Considering the submissions of the learned counsel for the petitioners, this Court deems it appropriate to dispense with the presence of the petitioners/A.2 to A.6 in C.C. No.4793 of 2022 on the file of the Judicial First Class Magistrate, Kurnool, subject to the petitioners filing an undertaking to appear before the Judicial First Class Magistrate, Kurnool as and when required. 4.
