Order
(2 of 2) [CW-3540/2025] 24/04/2025
1. For a limited purpose, the instant writ petition has been preferred seeking directions to the Rent Tribunal to decide the application filed by the petitioner under Section 23 of the Rajasthan Rent Control Act, 2001 (for short ‘the Act of 2001’).
2. Counsel submits that the aforesaid application was submitted by the petitioner on 03.12.2024, but in-spite of passing of considerable time, the same has not been decided by passing a reasoned and speaking order, so in the interest of justice, appropriate orders be passed for expeditious disposal of the aforesaid application.
3. Considering the limited prayer made by the counsel for the petitioner and looking to the fact that the application filed by the petitioner under Section 23 of the Act of 2001 is lying pending for adjudication since last more than four months, it is expected from the Rent Tribunal to decide the same expeditiously as early as possible, preferably within a period of two month from the date of receipt of certified copy of the order.
4. Before parting with this order, it is made clear that this Court has not issued any direction/order to the Tribunal to decide the application in a particular way and the same would be decided strictly in accordance with law after hearing the
arguments of both sides.
5. The stay application and all pending applications, if any, also stand disposed of.
