The Petition coming on for hearing, upon perusing the petition and the' memorandum of grounds fI'Ied in support thereof and upon hearing the arguments of SRI DUGGIRALA SUBASH, Advocate for the Petitioner, and of PUBLIC PROSECUTOR, for the R.espondent, the Court made the following fr THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 2159 of 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/Accused No.2, seeking regular bail, in Crime No.80 of 2024 of Maredumilli Police Station. 2. A case has been registered against the petitioner herein and others for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act,1985 (for short lthe NDPS Act') and section 111 (2)(b) of Bharatiya Nyaya Sanhita, 2023 (for short lthe BNS Act'). 3. Case of the prosecution, in brief, is that, on 24.09.2024, at about 2.00 PM, on receipt of cred'lble information, the Sub Inspector of Police, Maredumilli Police Station, along with his staff and mediators apprehended the Accused Nos.3 to 6 at Maddauluru Village and Mandal, while they were in possession and transportation of 22 Kgs of Ganja with the active support of Accused Nos.1 and 2. After seizing the contraband, the Sub Inspector of Police arrested Accused Nos.3 to 6 and a case has been registered against them. 4. Heard the learned counsel for the petitioner and learned Assistant l'----_* Public Prosecutor representing the respondent/State. Perused the material on record. 5. Learned Counsel for the Petitioner would submit that Similarly Placed J/ persons i.e. A3 and A4 have obtained regular bail from a Co-ordinate Bench of this court in the very same crime, vide order in Crl.P.No.9617 of 2024, dated 06.01.2025. 5. Learned Assistant Public Prosecutor would fairly submit that the Case Of the present petitioner is also on the same footing as of A3 and A4, who were already granted bail by this court. Learned Assistant Public Prosecutor would further submit that the Court may pass appropriate Orders. 6. ln that view of the matter, considering the SubmiSSiOnS made, Since A3 and A4 who are on the same footing as of Petitioner/A2 were released on bail, this court is inclined to grant bail to pet'ltioner herein on the following conditions:- (i) The petitioner/A2 shall be released on bail on his executing a personal bond for Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of the like sum each to the satisfaction of the I Additional Session Judge, Rajamahendravaram. ii) on release, the petitioner shall appear before the Station House officer concerned, twice in a week till filing of the charge sheet. 7. Accordingly, the Criminal Petition is allowed.
