Learned counsel for the petitioner submits that vide Annexure-P/2, the office of DFO, Forest Division, Rajnandgoan has initiated a proceeding for regularization of Daily Wages Employees. A list of Daily Wages employees working in the Department has been prepared, wherein the name of the petitioner has been placed at serial No. 1. In the remarks column, it has been mentioned that the name of the petitioner was wrongly left from the earlier list. (ii) Referring to a judgment of Coordinate Bench of this Court passed in WPS No. 904/2025 dated 03/02/2025, in which the memo dated 25/10/2024 issued by the State Govt, on the basis of which, the concerned Forest Department has initiated a proceeding for regularization of Daily Wages Employees in service, which was the subject matter of the said Writ Petition, wherein, the Coordinate Bench of this Court has directed the respondents authority to consider the case of the petitioner, he submits that since the petitioner has been working as Daily Wager since 01/11/1988, he is also entitled for regularization in service on the basis of memo dated 25/10/2024 issued by the State Govt.

Learned counsel for the State would submit that though the name of the petitioner appears in the list (Annexure-P/2) dated 28/03/2018 prepared for Daily Wages Employees for the year 2018, the petitioner in his petition has not pleaded as to why his case was not considered by the State on the previous occasion. Even, he has not pleaded anything about the memo dated 25/10/2024 on the basis of which he is claiming for regularization of his service.

4. I have heard counsel for the parties and perused the pleadings as well as the status report of the Forest Division Rajnandgaon.
5. From perusal of the status report dated 28/03/2018 (Annexure-P/2) which has been issued by the office of DFO, Rajnandgaon, it is quite vivid that the name of the petitioner has been mentioned at serial no. 1 in the list of Daily Wages Employees as he has been working since 01/11/1988.

Since the respondent/State has initiated a proceeding for regularization of Daily Wages Employees in service in light of memo dated 25/10/2024, Divisional Forest Officer, Rajanandgaon is directed to consider the case of the petitioner in light of the said memo dated 25/10/2024, and take necessary steps and pass appropriate orders in accordance with law within a period of 4 months from the date of receipt of copy of this order.
