On the last date of hearing, the Superintendent, Central Jail, Goindwal, was directed to be present in Court. In pursuance to the same, Shri Varun Sharma, Superintendent, Central Jail, Goindwal is present in Court, who apprises the Court that the petitioner was convicted and sentenced by the trial Court for three months of simple imprisonment in other FIR, which has not been completed so far. Learned counsel for the petitioner has fairly submitted that he may be allowed to withdraw the present petition with liberty to the petitioner to avail remedy before the Appellate Court concerned in accordance with law.
