The Writ Petition has been filed in the nature of a Public Interest Litigation seeking a direction against the 1st to 4th respondents to remove encroachment caused by the 5th to 7th respondents, who had put up a Peedam, Amman Idol, Hundi and two boxes made of thin sheet and arch made of Iron Pipe in Survey No.150/3 of Koppusithampatti Village, Pandhalkudi Revenue Village, Aruppukottai Taluk, Virudhunagar District. https://www.mhc.tn.gov.in/judis WP(MD) No. 16299 of 2025 __________ Page3 of 5 2.In the earlier hearing date, we had passed the following order: The first respondent District Collector Virudhunagar District may examine the nature of the land in S.No.150/3A3A at T.Koppusithampatti Village in Virudhunagar District with respect to which patta No.6223 had been granted indicating that it is a Government land. In that particular land, construction of peedam, Amman idol, Hundi and two boxes made of thin sheet and arch made of iron pipe had been put up and the petitioner is deeply aggrieved. 2.When the matter had come up for hearing before a Coordinate Bench of this Court, on 17.06.2025, the Division Bench had directed the third respondent Tahsildar, Aruppukottai to submit a report. Neither a report had been filed nor proper instructions had been forwarded to the learned Government counsel. 3.In view of this fact, the District Collector may take upon himself the responsibility of determining how these constructions were put up in a Government land and who authorised the same, more importantly, who were the Tahsildars in office from the date of the erection of such Hundi and peedam and other construction and when such construction had come to their notice. When Government land is encroached, the duty is cast on the revenue officials to take action by themselves, enquire into it and take steps to remove the encroachment. 4.The District Collector to file a report on all these issues by 21.07.2026. 3.Today, a report has been filed by the District Collector, wherein, he had stated that on inspection, encroachments had been found and notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 had been issued. 4.The said process to continue in accordance with law.
