Petitioner-Sanjeev Garg, aged 63 years, has filed the present petition under Section 528 of BNSS, 2023, seeking issuance of directions to the official respondents to refrain from harassing the petitioner and his family members on the basis of a false complaint bearing Nos. PGD- 631624 and 630950 dated 30.07.2025 (Annexure P-2), filed by respondents No. 5 and 6, who are none other than the petitioner’s mother and real brother, respectively. 2. It is further contended in the petition that similar complaints were filed earlier as well, but no adverse findings were made after inquiry. However, FIR No. 105 dated 22.04.2024 (Annexure P-1), registered under Sections 406, 420, and 120-B IPC at Police Station Sahnewal, District Police Commissionesrate Ludhiana, was filed against respondent No. 6 at the instance of the petitioner. Mr. Neeraj Madaan, Sr. DAG, Punjab, on instructions from ASI Binder Singh, submits that the complaint dated 30.07.2025 (Annexure P-2) was inquired into and consigned to the record room. However, submits that on the basis of fresh complaint, FIR No. 138 dated 15.08.2025 under Sections 318(4), 338, 336(3), 340(2), 61(2), 351 of BNS, 2023, Police Station Sarabha Nagar, District Police Commissionerate Ludhiana, has now been registered against the petitioner. 4. Faced with the above situation, Mr. S.P.S. Sidhu, Advocate, prays for withdrawal of the present petition with liberty to file a fresh and comprehensive petition detailing all the necessary particulars under the relevant provisions of law. 5. In view of above, present petition is dismissed as withdrawn, with liberty as sought and recorded above.
