1. Petitioner is seeking quashing of order dated 08.08.2024 vide which the bail granted to him was cancelled and his non-bailable warrants were issued.

Learned counsel for the petitioner contends that petitioner had gone to San Francisco but had requested his counsel to move an application for his exemption, who failed to move any such application and the bail was cancelled and his warrants have been issued. Learned counsel prayed that the impugned order be set aside as he is ready to appear before the trial Court and to face the trial.

On the other hand, learned State counsel has opposed the bail and argued that the petitioner went abroad without taking permission from the Court and the trial Court was justified in cancelling the bail and no interference in the impugned order is called for. It is not in dispute that the petitioner went abroad without seeking permission from the trial Court and in these circumstances, cancellation of bail vide order dated 08.08.2024 cannot be faulted with. No interference in the impugned order is thus called for and the petition is dismissed. However, trial Court shall decide the bail application of the petitioner within two days of his appearance, if any such bail application is moved after his surrender.
