The present appeal has been preferred against the judgment dated 07.08.2025 passed by the Addl. Sessions Judge, Sirsa in case bearing FIR No.138 dated 09.07.2025 registered under Sections 115, 126, 3(5), 351(2), 115(2), 117(2), 126(2) of BNS, 2023 and (Sections 3(1), (r) (s), 3(2) (va) of SC/ST Act added later on) at Police Station Nathusari Chopta, District Sirsa, dismissing the bail petition of the appellants. 2. The learned counsel for the appellants contends that a compromise has been arrived at between the parties as is evident from the affidavit/compromise dated 08.08.2025 (Annexure P-2) and therefore, the bail be granted to the appellants. The learned counsel for the State on the other hand, contends that serious allegations have been levelled against the appellants and therefore, the appellants are not entitled to the concession of bail. He, however, admits the factum of a compromise as also the period of custody undergone by the appellants who are incarcerated since 29.07.2025. 4. Mr. Aayush Bansal, Advocate has put in appearance on behalf of the complainant and has filed his power of attorney. The same is taken on record. He admits the factum of a compromise and states that the complainant has no objection, if the appellants are granted the concession of bail. 5. I have heard the learned counsel for the parties. 6. Keeping view the factum of compromise as also the period of custody undergone by the appellants who are incarcerated since 29.07.2025, the present appeal is allowed and the appellants are ordered to be released on bail subject to their furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned.
