For Petitioner : Mr.J.Sanjay Vignesh For Respondents 1 to 3 : Mr.R.Ramasamy Counsel for the State of Tamil Nadu For Respondent No.4 : Mr.M.Pandiarajan O R D E R Challenging the proceedings of the first respondent in Mu.Mu.No. 478876/2022/C6 dated 28.12.2023, the present Writ Petition has been filed. 2.The case of the petitioner is that the petitioner is the father of the fourth respondent and out of love and affection, the petitioner executed a ____________ https://www.mhc.tn.gov.in/judis W.P.(MD)No.9071 of 2025 settlement deed in Document No.11293 of 2019 dated 03.12.2015. Thereafter, since the fourth respondent failed to take care of the petitioner and his wife and also ill-treated them, the petitioner initiated proceedings under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, as against the petitioner before the second respondent. The second respondent, after enquiry, passed the impugned order dated 30.11.2022, refusing to cancel the settlement deed, however directing the fourth respondent not to interfere with the possession of the petitioner and his wife in the subject property. Thereafter, the petitioner preferred an appeal before the first respondent, who in and by proceedings dated 28.12.2023, confirmed the order of the second respondent. Aggrieved by the same, the petitioner is before this Court. 3.Learned Counsel for the petitioner would submit that though the respondents have passed an order directing the fourth respondent not to interfere with the possession of the petitioner, the fourth respondent is continuously interfering with their possession and several police complaints have also been lodged. Accordingly, he prays for cancellation of the settlement deed executed by the petitioner in favour of the fourth respondent, in order to enjoy the property peacefully till their life time. ____________ https://www.mhc.tn.gov.in/judis W.P.(MD)No.9071 of 2025 4.Learned Counsel for the fourth respondent would however, submit that the fourth respondent will not interfere with the possession of the petitioner and his wife and he will not alienate the property till their lifetime. Accordingly, he prays for appropriate orders. 5.Heard the learned counsel for the parties and perused the materials available on record. 6.Recording the submission made by the learned Counsel for the fourth respondent that the fourth respondent will not disturb the possession of the petitioner and his wife in respect of the subject property and will not alienate the same in favour of third parties, this Writ Petition is disposed of. However, liberty is granted to the petitioner to make a complaint before the jurisdictional police station, if there is any disturbance from the fourth respondent.
