PUBLIC PROSECUTOR The Court made the following Order: The petitioner is arraigned as Accused No.5 in Crime No.343 of 2024, on the file of Nakkapalli Police Station. The petitioner is alleged to have committed offence under Section 325 of the Bharatiya Nyaya Sanhita, 2023 (for short “BNS”) and Sections 5, 6 read with 10 of the Andhra Pradesh Prohibition of Cow Slaughter and Preservation of Cattle Act, 1977 (APPCSAPA Act). 2. The learned counsel for the petitioner, appearing virtually, submits that the petitioner is the owner of the lorry bearing vehicle No.AP39 TG 5656 and that the lorry belonging to the petitioner was seized when it was found to be transporting 18,290 kilograms of 2 beef meat. The learned counsel further submits that, the driver of the vehicle was instructed to bring the lorry from Rajamandry to Vishakhapatnam. It is submitted that, without the knowledge of the petitioner, the driver, in connivance with others, allegedly loaded the beef meat onto the lorry. It is submitted the petitioner asserts that he has no role in the commission of the offence and is not a part of any larger group involved in the alleged offence. 3. Considering the said submissions, the learned Assistant Public Prosecutor submits that the matter is still at the investigation stage. Accordingly, the criminal petition is disposed off, by directing the Station House Officer/Investigating Officer to follow the procedure contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS”).
