Heard learned counsel for the applicants and learned A.G.A. for the State. 2. The present application under Section 528 BNSS has been filed for quashing non-bailable warrant order dated 24.08.2016 as well as subsequent non-bailable warrants passed by learned Special Judge, Docoity Affected Area Act), Banda in Special Session Trial No.137 of 2009 (State vs. Dilshad and Others) arising out of Case Crime No.206 of 2009, under Sections 147, 148, 149, 307 IPC and sections 12/14 Docoity Affected Area Act and section 25 of Arms Act, Police Station- Baberu, District- Banda. 3. Learned counsel for applicants submits that impugned non- bailable warrant order is against the facts and law. The applicants had no knowledge about the proceedings initiated against them due to which they could not appear on the date fixed by the trial court, hence, non-bailable warrant was issued against the applicants. 4. Per contra, learned A.G.A opposed the prayer. 5. Be that as it may, none of the grounds taken up through the Versus Counsel for Applicant(s) : Manish Kumar Singh, Pavan Kishore Counsel for Opposite Party(s) : G.A. Dilshad And 2 Others .....Applicant(s) State of U.P. and Another .....Opposite Party(s) instant application are convincing for consideration of prayer as made through the instant application and as such applicants are hereby directed to appear before learned court concerned in pursuance to non-bailable warrant order dated 24.08.2016 as well as subsequent non-bailable warrants within four weeks from today. Till four weeks from today, no coercive action shall be initiated against the applicants. After the expiry of aforesaid period of four weeks, learned concerned court is directed to proceed as per law. 6. With the aforesaid observation, the application is disposed of.
