Hon'ble Donadi Ramesh,J. Heard learned counsel for the parties. The petitioner had earlier approached this Court by filing Writ-C No.45458 of 2023 which was came to be disposed of on 09.01.2024. A consequential order of the Divisional Engineer, dated 15.05.2024 is challenged on the ground that none of the petitioner's contentions are considered therein and only consideration and finding are that previous notice was valid. Learned counsel for the petitioner submits that the order impugned fails to answer the directions of the writ Court whereby consideration was required on the petitioner's claim. It it submitted that the order impugned merely reiterates earlier notice without considering the petitioner's submission in respect of such claim. Faced with the above challenge, learned counsel for the respondents Sri Pranay Krishna comes up with the prayer to permit the respondent-authorities to revisit the matter. In view of the fair stand taken, we quash the impugned order dated 15.05.2024 and direct the respondent-authorities to take note of the petitioner's objection to the previous notice and pass a fresh reasoned order in light of the above deliberations. Till a fresh decision is taken, status quo with regard to running of the shop shall continue. Accordingly, the instant writ petition is disposed off.
