ORDER:
1. The present Writ Petition is filed questioning the action of respondent Nos.2 and 5 in threatening to dispossess the petitioner from land admeasuring an extent of Ac.1.04 cents in Survey No.228-4a of Kotananduru village and Mandal, East Godavari District, without issuing any notice or without following the due process of law. 2. It is the case of the petitioner that he is the absolute owner and possessor of the subject land, having purchased the same by virtue of registered sale deed dated 18.02.1995, vide Document No.345/1995. He claims that, since then, he is in peaceful possession and enjoyment of the said land. 3. It is further case of the petitioner that he approached the 4th respondent seeking to mutate his name in revenue records and after conducting enquiry, his name was mutated in the revenue records and pattadar passbook was also issued in his favour. While so, the 4th respondent, without issuing any notice, tried to dispossess the petitioner, stating that the subject land is required for allotment of house site pattas. It is further case of the petitioner that the subject land is private patta land belonging to

him and the respondents without initiating the proceedings under Act 30 of 2013, the petitioner cannot be dispossessed from the subject land. 4. This Court, by order dated 17.03.2020, directed the respondents not to dispossess the petitioner from the subject land and the same was extended from time to time and it was extended until further orders, vide order dated 25.01.2021. 5. No counter affidavit is filed by the respondents. 6. Having considered the facts of the case, the present writ petition is disposed of, directing the respondents not to dispossess the petitioner from land admeasuring an extent of Ac.1.04 cents in Survey No.228-4a of Kotananduru village and Mandal, East Godavari District, without following due process of law. No order as to costs. As a sequel, pending applications, if any, shall stand closed.
