ORAL ORDER Learned High Court Government Pleader is directed to take notice for respondent No.1/State.
2. Heard both sides and perused the material on record.
3. The registration of FIR in Crime No.60/2024 at Urva Police Station, Mangaluru City for the offence

punishable under Section 427, 447, 448, 380 r/w 149 of IPC is assailed in this petition.
4. As could be seen from the FIR, the same is registered against 12 unknown persons, on a complaint lodged by respondent Nos.2 and 3.
5. The allegations are that during the wee hours on 07.06.2024, about 12 persons came in two vehicles bearing registration No.K2-21-Z-3068 and KA-19-MA-8167 with JCB vehicles etc., and trespassed into the complainant's property, demolished the house building, damaged the CC cameras, broke open the cupboard and took away DVR and monitor etc., and caused loss to the tune of Rs.9,00,000/- to the complainant etc.
6. Petitioner is not specifically named as an accused in the FIR. However, the police have issued a notice at Document No.3 summoning him to participate in the enquiry.

7. It is the contention of the learned counsel that petitioner is innocent and not at all involved in the offence and the police are now trying to harass him by issuing notice.
8. The notice is issued by the Police in the course of investigation. On that ground the entire proceedings cannot be quashed, as sought in the petition. The petitioner can appear before the concerned police and cooperate with the investigation. Hence, directing the police not to harass the petitioner in the guise of investigation, the petition is disposed of. I.A.No.1/2025 is disposed of.
