JUSTICE E.S.INDIRESH ORAL ORDER In these writ petitions, the petitioner is challenging the order passed by respondent No.1, directing the Public Information Officer of Directorate of Sericulture, Bengaluru, to provide information to respondent No.2 herein. 2. Parties are referred to as per their ranking in W.P.No.14339/2017. 3. Sri.T.P.Muthanna, learned counsel appearing for the petitioner, referred to the order passed by the First Appellate Authority at Annexure-C wherein the First Appellate Authority has rejected the claim made by respondent No.2 herein, however, respondent No.1 has passed the order, ignoring the rejection of the appeal by - 6 - HC-KAR NC: 2025:KHC:43363 WP No. 16245 of 2017 C/W WP No. 14339 of 2017 WP No. 16243 of 2017 the First Appellate Authority as per Annexure-C and accordingly, sought for interference of this Court. 4. Per contra, Sri.Mahantesh Shettar, learned Additional Government Advocate invited the attention of this Court to the provisions under the Right to Information Act, 2005 and submitted that the details sought by the petitioner or by respondent No.2 herein are the personal details of the leave, salary and such other issues and such aspects which cannot be made known to the third parties unless the applicant made out a case for the relevant purpose. 5. In the light of the submission made by the learned counsel appearing for the parties, respondent No.2 has made an application under Section 6(1) of the Right to Information Act, 2005. As per Annexure-B, the service details of the petitioner herein which came to be rejected and the same was confirmed by the First Appellate Authority as per Annexure-C dated 15.03.2017. - 7 - HC-KAR NC: 2025:KHC:43363 WP No. 16245 of 2017 C/W WP No. 14339 of 2017 WP No. 16243 of 2017 6. A perusal of the writ petitions would indicate that respondent No.1, without considering the order passed at Annexure-C, has directed the Department Personnel to provide information ignoring the rejection of the appeal filed by the respondent No.2 herein. Therefore, the rejection of the claim made by respondent No.2 as per Annexure-C is unchallenged. 7. Therefore, I am of the view that the communication dated 20.03.2017 at Annexure-A issued by respondent No.1 requires to be set aside in these writ petitions.
