The petitioner has preferred this application for grant of regular bail in connection with Nauhatta P.S. Case No. 95 of 2024 dated 11.06.2024 registered for the offences punishable under Section 302 of the I.P.C.
3. As per the prosecution case, the nephew of the informant received a call on his phone to join a dinner party near the pani tanki of the school of his village. In the next morning, the informant came to know that the dead body of his nephew was found hanging with the rope of jhula. Thereafter, the FIR has been lodged against unknown. 4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.89944 of 2024(3) dt.23-04-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case only because he was invited in the alleged dinner party. During the course of investigation, the co-accused Atul Kumar @ Banti in his confessional statement stated that he has organized the dinner party and invited the victim on mobile phone to join dinner party. On seeing the victim, the co-accused Ritesh Bhushan @ Panda and the other co-accused Ankit Kumar Chandravanshi have got angry as the victim has objection on love affair of Ritesh Bhushan @ Panda with his cousin sister and started assaulting the deceased and Ritesh Kumar @ Panda pressed the neck of the deceased and the co-accused Ankit Kumar Chandravanshi caught hold of the deceased due to that deceased died. As per the confessional statement of Atul Kumar there is no allegatin of overt act against the petitioner. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 08.08.2024. 5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. 6.
Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above- named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
