Heard learned counsel for the appellant, learned A.G.A. for the State and perused the record. This application has been filed for quashing of the entire criminal proceeding of Criminal Case NO. 206 of 2023 arising out of Case Crime No. 71 of 2023, under sections 323, 504, 506, 406 IPC and section 3(2)a, 3(1)(dha) SC/ST Act, P.S. Manjhanpur, District Kaushambi as well as impugned summoning order dated 24.07.2023 passed by Session Judge/Spl. Judge (SC/ST Act) Kaushambi. On perusal of the record, the Court finds that the allegations made in the first information report disclose commission of a cognizable offence and those allegations have found support from the material collected during the course of investigation on the basis whereof the police has laid a charge sheet against the appellants.Therefore, prayer for quashing the chargesheet as well as cognizance order stand refused. At this stage, in case appellants appear before the court below within 30 days from today and apply for bail, the same shall be heard and disposed of in accordance with law.
