General Manager-cum-Chief Engineer, Tenughat Thermal Power Station, having its office at Lalpania, P.O. & P.S.- Lalpania, District-Bokaro (Jharkhand).......Respondents --- CORAM: HON’BLE MR. JUSTICE DEEPAK ROSHAN -- For the Petitioner : Mr. Saurabh Shekhar, Anurag Kumar, Aman Dayal Singh, Advocates For the Resp.-State : Mrs. Moushmi Chatterjee, A.C to G.A.-V -- 02/15.04.2025 Heard learned counsel for the parties. 2. The instant writ petition has been preferred by the petitioner praying for a direction upon the Assistant Labour Commissioner for early disposal of the claim petitions being M.W No. 9 of 1999 and M.W No. 10 of 1999 pending before the learned Court of Minimum Wages Authority -cum- Assistant Labour Commissioner, Bokaro, as the said matters were remanded by the Deputy Labour Commissioner –cum- Appellate Authority, Minimum Wages Act, Bokaro vide order dated 09.05.2002 and 11.05.2002 passed in M.W Appeal No. 01 of 2000 and MW Appeal No. 02 of 2000, respectively. 3. From perusal of paragraph-13 of the writ petition, it appears that pursuant to the orders dated 09.05.2002 and 11.05.2002 passed by the Deputy Labour Commissioner-cum-Appellate Authority, the matters were remanded back to the Minimum Wages Authority-cum- 2025:JHHC:12121 2 Assistant Labour Commissioner, Bokaro and the matters were heard on several dates between 2002 to 2011, but no final order was passed. Further fact reveals that the petitioner has also filed an application for speedy disposal of claim petitions before the concerned authority. 4. It is unfortunate that quasi-judicial authorities are treating the cases before them in most casual manner. Be that as it may; the instant writ application, is hereby, disposed of by directing the Assistant Labour Commissioner, Bokaro where both the matters are pending after the remand order by the Deputy Labour Commissioner, Bokaro way back in the year 2002 itself; to decide the matters and pass final order as early as possible but not beyond the period of 12 weeks. It is made clear that since the present officer might be a new one and might not be well aware with the facts of these two cases mentioned in the writ application; as such, the present incumbent i.e., Assistant Labour Commissioner, Bokaro, who is Minimum Wages Authority for the concerned two matters, shall notice the parties, if he requires, for early disposal or hearing the matters afresh, but in no case he shall delay the matters and must pass the final order in both the pending cases within the aforesaid stipulated time. 5. Accordingly, the instant writ petition stands disposed of in the manner indicated hereinabove. (Deepak Roshan, J.) jk
