HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL REVISION No. - 4932 of 2025 Court No. - 84 HON'BLE SUBHASH CHANDRA SHARMA, J. Heard learned counsel for the revisionist as well as learned A.G.A. and perused the material on record. This criminal revision has been filed by the revisionist with prayer to set aside the impugned judgment and order dated 28.05.2025 passed by the learned Additional Principal Judge, Family Court, Court NO. 2, Azamgarh in Case No. 427 of 2021 (Sangeeta Gond Vs. Harishchand Gond), under Section 125 Cr.P.C., Police Station Maharajganj, District Azamgarh. It is submitted by learned counsel for the revisionist that in this case, the opposite party no. 2 is wife who is living apart from him without any sufficient cause. The marriage was performed in the year 2009. She made false allegation against the revisionist regarding illicit relations with his bhabhi, though there is nothing such. There is no any neglect on his part even though she is living apart from him. He works as labourer even though amount as fixed by the learned trial court is excessive and beyond his paying capacity, therefore, request to set aside the order passed by the learned trial court and allow the revision. Learned A.G.A. opposed the prayer as aforesaid. On considering the facts and circumstances of the case, submissions made by learned counsel for the revisionist as well as learned A.G.A. perusal of record and order passed by learned trial court dated 28.05.2025, it appears that in this case, the marriage between the opposite party no. 2 and revisionist was performed in the year 2009. They lived as husband and wife Versus Counsel for Revisionist(s) : Ram Ker Singh, Vineet Singh Parmar Counsel for Opposite Party(s) : G.A. Harishchand Gond .....Revisionist(s) State of U.P. and Another .....Opposite Party(s)
for a long time and thereafter allegation regarding character of the wife was made by the revisionist and also she was harassed that was the reason she started living separate from him. He has not given any money to the wife for her maintenance, it also shows that due to neglect and misbehavior on the part of the revisionist, the opposite party no. 2 is living apart from him that is sufficient cause. Since the revisionist works as labourer as per his admission. The amount of maintenance Rs.
5000/- per month in favour of wife can also not be said to be more than sufficient or excessive, since the wife is not able to maintain herself and has having no any source of income. In this way, there appears no any illegality or impropriety in the order passed by the learned trial court dated 28.05.2025 and it does not warrant interference by this Court but this revision being devoid of merit is liable to be dismissed at the admission stage itself. Accordingly, this criminal revision is dismissed. September 1, 2025 Anurag Singh CRLR No. 4932 of 2025 2 (Subhash Chandra Sharma,J.)
