1. Heard Sri Jamal Ahmad Khan, learned counsel for the petitioner and learned Standing Counsel for the State.
2. By means of this petition filed under Article 226 of Constitution of India, petitioner has prayed for a direction to the respondent no.2 to release the amount of gratuity and leave encashment as he has already stood retired on 31.07.2024 and yet in the name of pending disciplinary proceedings the same has remained witheld.
3. It is argued on behalf of the petitioner that on the date of his retirement petitioner was served with the chargesheet and thereafter departmental enquiry was conducted which has already concluded and yet no order has been passed upon the same and thus petitioner continues to remain denied of complete disbursement of post retirement dues. 5. In such above view of the matter, I dispose of this petition with direction to the disciplinary authority, namely, respondent no.2 to conclude the disciplinary proceedings initiated against the petitioner pursuant to the chargesheet dated 30.07.2025 positively within a period of two months of production of certified copy of this order.
