ORAL ORDER This petition is filed by accused No.1 under Section 482 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant anticipatory bail in Crime No.138/2025 of Belur Police Station, registered for offences punishable under Sections 118(1), 352, 109, 351(2) read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023.
2. Heard the learned counsel for petitioner and learned Additional State Public Prosecutor for respondent - State.

Learned counsel for petitioners would contend that, the charge sheet has been filed and column No.17 of

the charge sheet discloses that the accusation against this petitioner is that he caught hold of C.W.2 and there is no alleged overtact of assault against this petitioner. The petitioner is not having any criminal antecedents as observed by the Sessions Court. i.e., in Crime No.98/2025 of Belur Police Station. Chandan who involved in Crime No.98/2025 of Belur Police Station is not this petitioner and the said Chandan is a son of Shivakumar. But the father name of this petitioner is Manjunatha. The injured has sustained simple injuries. The overtact of assault is alleged against accused Nos.2 and 3. As the charge sheet is filed, the petitioner is not required for custodial interrogation. The petitioner is ready to appear before the trial Court on all dates of hearing and cooperate for speedy disposal of the case. With these, he prayed to allow the petition. 4. Learned Additional State Public Prosecutor for respondent would contend that, the injured has sustained four (4) injuries and all are simple injuries. The petitioner

is having criminal antecedents and he is involved in Crime No.127/2023 of Belur Police Station for causing simple hurt. With these, she prayed for dismissal of the petition. 5. Having heard the learned counsels appearing for parties, the Court has perused the charge sheet and other materials placed on record. 6. As per column No.17 of the charge sheet, the accusation against this petitioner is that, the quarrel is between accused persons and the injured i.e., C.W.2. The petitioner and accused No.2 held C.W.2 and accused Nos.2 assaulted the C.W.2 with beer bottle on his lips and ear and caused simple injury. Accused No.3 assaulted the C.W.2 with club on his waist and left knee and caused simple injury. Considering the said accusation, no overtact of assault is alleged against this petitioner. As the charge sheet is filed, the petitioner is not required for custodial interrogation. The petitioner has undertaken to appear

before the trial Court on all dates of hearing unless exempted and cooperate for speedy disposal of the case. 7.
Considering all the above aspects, the petitioner has made out a case for grant of anticipatory bail with conditions. In the result, the following;
ORDER The Criminal Petition is allowed. The petitioner is granted anticipatory bail in Crime No.138/2025 of Belur Police Station and is ordered to be released on bail in the event his arrest, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum to the satisfaction of the jurisdictional Court. ii) The petitioner shall voluntarily appear before the jurisdictional Court within 10 days from this day and execute bail bond and furnish surety.

iii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. iv) The petitioner shall appear before the trial Court on all dates hearing unless exempted and cooperate for speedy disposal of the case. v) The petitioner shall not involve in commission of any offence. If the petitioner found involved in commission of any offence, the prosecution is at liberty to seek cancellation of his bail.
