JUSTICE MITALI THAKURIA ORDER 03.04.2025 Heard Mr. C. Goswami, learned counsel for the petitioner. Also heard Mr. R. J. Baruah, learned Additional Public Prosecutor for the State respondent. This is an application filed under Section 482 of BNSS, praying for grant of pre-arrest bail to the petitioner, who is apprehending arrest in connection with Baghbar P.S. Case No. 08/2025, under Sections 61(2)/329 (4)/70(1)/351(2)/354 (3) of BNS read with Section 6 of the POCSO Act. The case was listed today for production of the Case Diary before this Court, however, Mr. Baruah, learned Additional Public Prosecutor has submitted that the I.O. has already filed Charge-Sheet in this case, vide Charge-Sheet No. 22/2025, dated 31.03.2025. In this regard, Mr. Goswami, learned counsel for the petitioner, submits that the petitioner has already been arrested in connection with this case. Accordingly, he submits that the matter has become infructuous. Considering the submissions made by the learned counsels for both sides and also considering the fact that the case has already been charge-sheeted, I hereby direct the present petitioner to appear before the learned Trial Court with a proper application and the said Court shall consider the same in accordance with law.
