JUSTICE G BASAVARAJA - 3 - HC-KAR NC: 2025:KHC:47166 CRL.A No. 2192 of 2025 ORAL JUDGMENT The appellant/accused-9 has preferred this appeal against the order passed by the Principal District and Sessions Judge, Chamarajanagar in Crime No.167/2025 dated 18.10.2025. 2. The brief facts leading to this appeal is that on the base of the complaint filed by Mahadevaswamy, Chamarajanagar Rural Police have registered the case in Crime No.167/2025 against the accused Nos.1 to 10 for the offence punishable under Section 191, 417, 419, 420, 468, 471 of IPC and Section 3(1) (f) of SC ST (Prevention of Atrocities) Act 1989. 3. On 10.10.2025 the accused/appellant was arrested by the concerned police and produced before the Principal District and Session Judge at Chamarajanagara, he was remanded to judicial custody, till this date appellant is in Judicial Custody. The appellant had filed application under Section 439 of Cr.P.C for grant of regular bail and the same came to be rejected on 18.10.2025. - 4 - HC-KAR NC: 2025:KHC:47166 CRL.A No. 2192 of 2025 Being aggrieved by this order, the appellant has preferred the present appeal. 4. It is submitted by the learned counsel for the appellant that this Court has already granted bail to accused Nos.1 and 2 in Criminal Appeal No.1993/2025 dated 16.10.2025. Considering the facts and circumstances of the case, in view of principles of parity, I proceed to pass the following:- ORDER Appeal is allowed. The order passed by the Principal District and Session Judge, Chamarajanagara in Crime No. 167/2025 dated 18.10.2025 is set aside. Consequently application filed under Section 482 of BNSS is allowed, subject to following conditions:- i. The appellant shall be released on bail on executing a self bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with one surety for the likesum to the satisfaction of the concerned Court. - 5 - HC-KAR NC: 2025:KHC:47166 CRL.A No. 2192 of 2025 ii.
