2. The case of the petitioner is that he and the 6th respondent are brothers. The petitioner’s mother owned a land comprised in S.F.No. 729/13-B, measuring an extent of 0.20.5 Hectares.
Following the demise of their mother, the petitioner and the 6th respondent were in joint possession of the subject property, and a joint patta was issued in their names. The petitioner and his brother jointly enjoyed the property without effecting any partition. While so, the 6th respondent fraudulently obtained a separate patta in his individual name and subsequently created third-party rights over the subject property. Aggrieved by this, the petitioner submitted a representation dated 25.03.2025 to Respondents 1 to 5, requesting them to cancel the said illegal separate patta and restore the joint entry as per the old revenue records. As the said representation was not considered, the petitioner has approached this Court. 3. When the matter is called, there is no representation on behalf of the petitioner. At this juncture, the learned Government Advocate appearing for the official respondents submitted that the dispute is purely civil in nature. He further submitted that since the petitioner and his brother had sold portions of the property independently, the patta was mutated accordingly, and if there is any ongoing dispute regarding the same, it must be adjudicated before a competent Civil Court. https://www.mhc.tn.gov.in/judis
