GP FOR REVENUE (AP) The Court made the following: ORDER:- Heard Sri K.Raghuveer, learned counsel for the petitioner and learned Assistant Government Pleader for Revenue. 2. Challenging the action of the 3rd respondent/Tahsildar in attempting to dispossess the petitioner from the subject land in an extent of Ac.0.80 cents in Sy.No.88/1 of Gownithimmepalli Village, in order to issue house site pattas in favour of the beneficiaries of the scheme viz., “Navaratnalu – PedalandarikiIllu”, the present writ petition is filed. 3. The 3rd respondent/Tahsildar has filed counter affidavit stating that it is not correct to say that the petitioner is an encroacher and it is further 2 stated that during the inspection, the Tahsildar had found one encroacher namely K.Gangi Reddy in the subject land in an extent of Ac.0.55 cents and directed the encroacher to vacate the land. The said encroacher K.Gangi Reddy vacated the land voluntarily with certain conditions to leave the way to his patta land. However, subsequently filed a writ petition in W.P.No.4264 of 2020, and the said writ petition was disposed of. The petitioner and his family members' possession over the subject property was denied. It is further stated that the petitioner has land in different Sy.No.111/6 in an extent of Ac.0.96 cents of the same Village on southern side of the subject land (Sy.No.88/1) classified as Rasta. The petitioner was issued pattadar pass book and title deeds in respect of the said land. 4. In that view of the matter, the grievance of the petitioner is that the respondents are trying to dispossess the petitioner from the subject land in Sy.No.88/1, which is classified as rasta poramboke, would not merit consideration. 5. In the light of the submissions of the 3rd respondent/Tahsildar, the writ petition is disposed of. There shall be no order as to costs.
