ORAL ORDER
1. This petition is filed by the sole accused under Section 482 of Bharatiya Nagarika Suraksha Sanhita (hereinafter referred to as the `BNSS’) praying to grant anticipatory bail in Crime No. 66/2024 of Kodigenahalli Police Station registered for offence under Sections 380 and 328 of IPC.
2. Heard learned counsel for petitioner and learned Additional SPP for respondent – State.

Learned counsel for petitioner would contend that the complainant in his complaint has stated regarding the theft of 8 Gms finger ring and 22 Gms gold chain and in his further statement stated that when he came back after filing complaint he found the said 8 Gms finger ring and 22 Gms

gold chain in his house. The complainant also stated in his further statement that the gold chain of his son which he had stated to be weighing 30 Gms is 10 years old and several times he had repaired it and now its weight is 25 Gms. Considering the same there is a discrepancy in the averments of complaint and further statement of the complainant. The complainant who has stated that he has received phone call from the accused has not mentioned the phone number in his complaint. The theft articles have been recovered in Crime No. 49/2024 of Iijur Police Station. The theft articles have been released to the complainant. As charge sheet is filed the petitioner is not required for custodial interrogation. With this he prayed to allow the petition. 4. Per contra learned Additional SPP would contend that from the possession of this petitioner, 18 articles have been recovered in Crime No. 49/2024 of Iijur Police Station and out of them, two golden articles are pertaining to the present crime. Out of those articles, one strip of Zol fresh 10 mg tablets was also seized and in FSL report it is stated to be

a sedative drug. The petitioner in his voluntary statement has admitted of he having committed theft in 5 houses. The petitioner is having criminal antecedents and is involved in commission of similar offence in 5 cases. If the petitioner is granted anticipatory bail, he will commit similar offence and will not be available for trial. With this, she prayed to reject the petition. 5. Having heard learned counsel for the parties this Court has perused the charge sheet and other materials placed on record. 6. As per charge sheet, the case of the prosecution is that the petitioner stating his name as Siddapatil, contacted the complainant, who is a retired teacher, by mentioning the names of several teachers and asked for shelter for the night of 16.05.2024.
On the said night after consuming food, both slept and in the morning the complainant found missing of cash and golden articles. During investigation in Crime No. 49/2024 of Iijur Police Station, the petitioner was arrested and 18 articles have been seized from his possession. Out of

those 18 articles, 2 golden articles were pertaining to this case and they have been identified by the complainant and they have been released to the complainant. One Zol fresh 10 mg strip which was also one of the articles seized is found to be a sedative drug. Said tablet has been used by this petitioner and had given it to the complainant by mixing it in food. The petitioner is involved in 5 similar cases of different Police Stations. Considering the same, the petitioner is having criminal antecedents. If the petitioner is granted anticipatory bail, he will commit similar offence. Considering the above aspects, the petitioner is not entitled for grant of discretional relief of anticipatory bail. 7. In the result, petition is dismissed. Sd/- (SHIVASHANKAR AMARANNAVAR) JUDGE
