The petitioner- Deepak Kumar Choudhary @ Deepak Choudhary has been made accused in connection with S.T. No.533 of 2023 arising out of Mango P.S. Case No. 157 of 2023 corresponding to G.R. No.1495 of 2023 for the offence registered under Sections 323, 324, 326, 307, 302/34 of the Indian Penal Code, Sections 27, 25(1-B)a, 26, 35 of the Arms Act pending in the Court of learned Additional Sessions Judge VIII, Jamshedpur. Earlier bail application of this petitioner was rejected vide order dated 06.12.2024 with a direction to conclude the trial within three months. It is submitted that the prosecution is deliberately delaying and procrastinating the trial by adopting dilatory tactics. After the last order passed by this Court, the prosecution evidence was closed on 16.01.2025 and the statement of the accused/petitioner was recorded on 21.01.2025 under Section 313 of the Cr.P.C. and the defence evidence was also closed on 17.02.2025. The case was posted for argument and thereafter, on application under Section 311 of the Cr.P.C., the same was allowed for examination of Doctor and I.O. After the examination, the statement of the accused was again recorded under Section 313 of the Cr.P.C. and at the verge of conclusion of the trial, another petition has been filed under Section 311 of the Cr.P.C. The petitioner is in custody since 05.06.2023 and because of intermittent applications filed on behalf of prosecution, the trial has not been concluded. Learned A.P.P. assisted by learned counsel on behalf of informant opposed the prayer for bail. Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below with a condition that one of the bailors must be family member of the accused.
