Heard learned counsel for the petitioner and learned Standing Counsel for the respondents. 2. The petitioner by means of the present writ petition has prayed for the following reliefs:- "(A). Issue a writ, order or direction in the nature of mandamus directing and commanding the respondent No.4-Executive Officer, Nagar Panchayat Severahi, District Kushinagar not to interfere into peaceful possession of the petitioner having house No.102 area 01 Kattha 10 Dhur/2614 Sq. Ft. of arazi No.331 situated in ward No.15, Malaviya Nagar (Old No.10, Indra Nagar), Severahi, District Kushinagar. (B). Issue any other suitable writ, order or direction in the nature as to this Hon'ble Court may deem fit and proper under the circumstances of the case. (C). Award the cost of the writ petition to the petitioner." 3. This Court vide order dated 02.09.2025 directed the learned counsel for the respondents to seek instructions in the matter. 4. Sri N.N. Mishra, learned counsel for the respondent No.4 on instructions which is taken on record states that the Araji No.331 is recorded as category 6(2) land and therefore, this is a public utility land. The instructions are being reproduced herein below:- "जॉचोपरान्त अवगत कराना है िक नगर पंचायत सेवरही वाडर् नं0 15 मालवीय नगर पुराना वाडर् नं0 08 इिन्दरा नगर में िस्थत मकान सं0 102 नगर पंचायत गृहकर पंिजका में श्री मुरली मनोहर पुत्र नरायन प्रसाद के नाम से अंिकत है। राजस्व िवभाग से प्राप्त लेखपाल आख्या में उल्लेिखत है िक प्रश्नगत मकान सं० 102 राजस्व ग्राम सेवरही टाउन एिरया, त०-वा०जो०, परगना-िस०जो० तहसील तमकु हीराज िजला कु शीनगर के Versus Counsel for Petitioner(s) : Dileep Kumar Srivastava Counsel for Respondent(s) : C.S.C., Dileep Kumar Srivastava Murali Manohar Srivastava .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) राजस्व अिभलेख खतौनी में आराजी नं० 331/3.780 हे0 में िस्थत है, जो आबादी श्रेणी 6 (2) के नाम दजर् अिभलेख है। आख्या की प्रित संलग्न है। (संलग्नक-01) मौके पर याची के मकान सं० 102 की वतर्मान चौहदी में उत्तर-रास्ता. दिक्षण मुख्य मागर्, पूरब-रास्ता, पिश्चम-गली है। स्थानीय लोगो द्वारा बयान िदया गया है िक उक्त गली में पूवर् से ही नाली िनिमत रही है गली से होकर रास्ता भी आम जनमानस हेतु पूवर् से संचािलत रहा है। बयान की प्रित संलग्न है। (संलग्नक-02) याची द्वारा सावर्जिनक गली को मकान सं० 102 का िहस्सा बताना सही नहीं हैं, गली आबादी क्षेणी 6(2) की भूिम में िस्थत है तथा सावर्जिनक है।" 5. Since there is a disputed question of fact as to whether the Araji No.331 is recorded as owned by the petitioner or recorded as category 6(2) land, therefore, such question cannot be decided by this Court under Article 226 of the Constitution of India. In such view of the fact, the writ petition is dismissed with liberty to the petitioner to avail appropriate remedy available in law.
