Heard Sri Ajay Kumar Pandey, learned counsel for the petitioner, Sri Mehul Khare, learned counsel for respondent No.4 Canera Bank and learned Standing Counsel for respondent Nos.1, 2 and 3. 2. The present writ petition has been filed challenging the recovery sale notice dated 8.8.2025 issued under Section 13(4) of the Securitization and Reconstruction of Finalcial Assets and Enforcement of Security Interest Act, 2002 read with Rule 8(6) of the Security Interest (Enforcement) Rules, 2002. By the aforesaid sale notice, the property was directed to be auctioned on 30.08.2025. 3. It is argued by Sri Khare, learned counsel appearing on behalf of respondent no.4 that on the said date, the auction proceedings could not be held, hence the present writ petition has become infructuous. 4. On the other hand, it is argued by learned counsel for the petitioner that the petitioner is ready to deposit the entire amount and in fact a sum of Rs.4,50,000/- has already been deposited by the petitioner with the respondent-Bank on 08.09.2025. 5. With the consent of the parties and also in the interest of justice, the present petition is disposed of finally permitting the petitioner to approach the Branch Manager, Canera Bank, Chandauli Branch, District Chandauli along with his offer letter within one week from today. In case such an offer Versus Counsel for Petitioner(s) : Ajay Kumar Pandey, Amit Kumar Pandey Counsel for Respondent(s) : C.S.C., Mehul Khare Vijeta Nand Tiwari .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) is made, the respondent no.4 shall consider the same and take a decision within two weeks thereafter. 6.
