A joint memo and application under Section 147 of the N.I.Act is filed. The joint memo is filed by petitioner, respondent and their respective counsels. As per the averments of the joint memo, the matter is settled for Rs.80,000/- including the amount of Rs.45,000/- which is deposited by the petitioner before the trial Court. Petitioner has no objection for the respondent to withdraw the said amount. Petitioner has paid Rs.35,000/- to the respondent. Respondent reports receipt of cash of Rs.35,000/-. In view of the above settlement, the offence under Section 138 of the N.I.Act is compounded. Accordingly, the application under Section 147 of the N.I.Act is allowed. The respondent is permitted to withdraw the amount of Rs.45,000/- deposited by the petitioner before the trial Court.
