Heard learned counsel for the petitioners, learned standing counsel for respondent nos. 1 to 3 and Sri Avinash Chandra Srivastava, learned counsel for respondent no. 7. 2. Present petition has been filed with following relief; "i. To issue a writ, order or direction in the nature of mandamus directing the respondent nos. 2 to 7 not to construct the Raod (Rasta) from the Bhumidhari Land Gata No. 267 M situated in Village Poiya, Tehsil- Etmadpur, District -Agra without following the due procedure established under law. ii. To issue a writ, order or direction in the nature of mandamus directing the respondent nos. 2 to 7 to construct the Rasta (Road) through Gata No. 258 situate in Village Poiya, Tehsil- Etmadpur, District -Agra after demarcation from fixed points." 3. This Court vide order dated 01.09.2025 has directed the learned standing counsel to seek instruction. 4. Pursuant to order dated 01.09.2025, learned standing counsel has produced instruction dated 22.09.2025, which is taken on record. 5. As per instruction, earth work has only conducted to construct the road upon Gata No. 258 and no construction etc. has been raised upon Gata No. 267 M situated in Village Poiya, Tehsil- Etmadpur, Agra.
