Order 28/03/2025
1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.48/2024, registered at Police Station Pahadi, District Deeg, for the offence(s) under Sections 147, 148, 149, 224, 336, 332, 353 and 307 of IPC.
2.
Learned counsel for the accused petitioners submits that the accused-petitioners have falsely been implicated in this case. The injuries sustained to Police Officials are not dangerous to life. The allegation against the accused-petitioners and the other co- accused are omnibus in nature. It is alleged that the accused- petitioners and the other co-accused pelted stones at the Police
[2025:RJ-JP:14466] (2 of 3) [CRLMB-3088/2025] Officials. It is contended that the case of the petitioners are akin to the other co-accused namely- Arsad and Arif, who have already been enlarged on bail. The bail application of the accused- petitioners was rejected by the learned trial Court, solely on the ground that the accused-petitioners were found to be involved in other criminal cases. The accused-petitioners are in custody since 10.02.2025, the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. It is contended that both the petitioners are habitual offender and against them several criminal cases have been registered. It is contended that both the petitioner were found to be involved in pelting stone at Police Officials, therefore the bail application of the accused-petitioners may be dismissed. 4. Heard and perused the material available on the record. 5. It is not desirable to express anything on the merits of the case. Considering the fact that the other co-accused have already been enlarged on bail and the charges against the accused- petitioners are akin to the other co-accused. The accused- petitioner is in custody since long and trial of the case may take considerable time, therefore, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioners-
