HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 30228 of 2025 Court No. - 50 HON'BLE AJAY BHANOT, J. Matter is taken up in the revised call. Heard Shri Indra Mohan Singh, learned counsel for the applicant and learned AGA for the State. This is the second bail application. By means of this bail application the applicant has prayed to be enlarged on bail in Case Crime No. 477 of 2023 at Police Station Gauribazar District Deoria under Section 376D, 504, 506, 34 I.P.C. and Section 3/4 POCSO Act and Section 67 I.T. Act. The applicant is in jail since 25.11.2023. The first bail application of the applicant was rejected by this Court on 15.04.2024. The trial is on foot. The victim is yet to be examined. No fresh ground for bail is made out at this stage. Without going into the merits of the case, the bail application is dismissed. Learned counsel for the applicant submits that only two witnesses have been examined till date. Various directions were also made upon the learned trial court to expedite the trial and to implement the mandate of Section 309 Versus Counsel for Applicant(s) : Indra Mohan Singh, Vikas Tiwari Counsel for Opposite Party(s) : G.A. Ajeet .....Applicant(s) State Of U.P. And 3 Others .....Opposite Party(s) Cr.P.C./346 BNSS. Prima facie, it appears that the directions of this Court rendered on 15.04.2024 in the first bail application registered as Criminal Misc. Bail Application No. 7477 of 2024 have not been complied with and this is a rather distressing state of affairs. Disobedience of orders of this Court by the learned trial court strikes directly at the root of the rule of law. Learned District Judge, Deoria shall oversee the compliance of the directions of this Court to conclude the trial and ensure strict compliance of the directions issued by this Court in the first bail application registered as Criminal Misc.
