JUSTICE SUSMITA PHUKAN KHAUND ORDER Date : 28.03.2025 Heard learned counsel Mr. A.A Dewan for the petitioner Mullah Jahangir Alom who has filed this application under Section 483 of the BNSS, 2023 for prayer of bail as the petitioner is behind bars since 03.02.2025 in connection with Dispur PS Case No. Page No.# 2/2 85/2025 under Section 143(2) of BNS, 2023. The allegation against the petitioner is that he induced the victim to stay in a booked room in a hotel and have physical relationship with him. I have also scrutinized the Case Diary. The merits of this case are not brought to the fore as investigation is still under progress. It appears that further custodial detention may not be required for the progress of investigation. The petitioner is a local resident and he has pledged to co- operate with the remaining part of the investigation. Considering all aspects, the petitioner is enlarged on bail of Rs 50,000/- with a suitable surety of like amount to the satisfaction of the C.J.M, Kamrup(M) under the condition that (1) the petitioner shall refrain from such activities with which he is alleged, and (2) the petitioner shall not exercise threats to the witnesses.
