JUSTICE R DEVDAS ORAL ORDER Learned High Court Government Pleader takes notice for all the respondents. 2. It is the contention of the petitioner that his father, late Ramaiah, was in unauthorised occupation of a house site - 3 - HC-KAR NC: 2025:KHC:38966 WP No. 29348 of 2025 situated at Hosahalli Village, Varthur Hobli, Bangalore East Taluk. The petitioner's father put up a residential premises long ago and the petitioner along with his family members are residing in the said place. Learned counsel points out to Annexure-F a circular dated 06.07.2016 issued by the Under Secretary to Government, Revenue Department (Land Grant-1) calling upon all such persons who are in unauthorised occupation of residential sites to file application seeking regularisation of unauthorised occupation. Accordingly the petitioner has filed an application at Annexure-A dated 04.08.2021 seeking regularization of the petition schedule property. However till date the applications have not been considered. 3. Having regard to the contentions raised in the writ petition and submission of the learned Counsel for the petitioner, this Court is of the considered opinion that respondent-Tahsildar was duty bound to consider the representation of the petitioner and pass necessary orders. 4. The writ petition stands disposed of with a specific direction to respondent No.4-Tahsildar, K.R.Puram Taluk, to - 4 - HC-KAR NC: 2025:KHC:38966 WP No. 29348 of 2025 verify from the records as to whether such an application was filed by the petitioner on 04.08.2021 is pending consideration. If it is found that such an application was indeed filed by the petitioner and the application is yet to be considered, the Tahsildar is directed to consider the application and pass orders in accordance with law as expeditiously as possible and at any rate within a period of two months thereafter and pass necessary orders. Needless to observe that till the application filed by the petitioner is considered the possession of the petitioner in respect of the dwelling house shall not be disturbed. Ordered accordingly.
