ORAL ORDER
The present petition is filed aggrieved by the order passed in I.A.No.5 in Crl.Misc.No.595/2014 dated 03.08.2022 by the V Additional Principal Judge, Family Court, Bengaluru, whereby the Family Court had directed the petitioner/husband to pay an amount of Rs.5,000/- per month to the respondent/wife from the date of application till disposal of the petition and to pay an amount of Rs.90,000/- in lump sum towards medical expenses. The order dated 03.08.2022 is questioned before this Court in the year 2024 nearly after two years.
2. Learned counsel appearing for the petitioner/husband submits that the husband had not realized that such an order is passed and once he realized that an order is passed, he has come up before this Court by filing a writ petition.
3. The Family Court had done the exercise and passed an order on 03.08.2022 and Crl.Misc.No.595/2014 is of the year 2014. When an order is passed by the Court, either the party has to comply with it or they should file an appeal/revision within a reasonable time and they should make

the efforts to get an order from the appellate/revisional Court seeking stay of the impugned order. In this case, the petition is filed nearly after two years from the date of order and the matter came up before this Court for the first time on
15.04.2024. On that day, as per the order sheet, there was no representation on behalf of the petitioner and the matter was
directed to listed after ensuing Summer Vacation. Then when the matter came up on 23.09.2024, this Court had directed the Registry to issue notice to the respondent and directed the matter to be listed after Dasara Vacation 2024. Even on 20.06.2025, there was no representation on either side on call and to give a fair opportunity, the matter was directed to be listed on 31.07.2025.
4. On 31.07.2025, the order sheet reveals that the
learned counsel for the respondent is present and there is no representation on behalf of the petitioner. Hence, the matter was directed to be listed for 'dismissal' on 20.08.2025. Accordingly, the matter is listed under the caption 'dismissal' today. The conduct of the petitioner from the year 2022 till 2025 shows that the petitioner has no intention to prosecute

the matter and the petitioner has not complied with an order that is passed in the year 2022 and he has never made any efforts to press for the I.A. seeking stay of the order impugned. In these circumstances, this Court do not want to go into the merits of the matter and this matter do not require any
consideration in the hands of the Court where the litigant is not vigilant and also there are no bona fides in filing the writ petition after two years from the date of order. In that view of the matter, this Court is passing the following order:
ORDER
i. Accordingly, the writ petition is dismissed.
ii. All I.As. in this petition shall stand closed.
